The Kimberly Diamond
Act of 2003
The Kimberly Diamond Act of 2003 was
created to try and stem the flow of illegal black market diamond rough
by requiring certificates of origin for diamond rough being exported or
imported to countries who choose to participate.
The global diamond industry has a zero tolerance policy towards the
trade in conflict diamonds. In the year 2000, the World Diamond
Council was formed to help eradicate the trade in conflict diamonds.
Together with non-governmental organizations (NGO's) and governments
throughout the world, the Kimberly Process was adopted which banned the
sale and trafficking of conflict diamonds. Under the Kimberly
Process, rough diamonds mined from legitimate operations are sealed in
tamper resistant containers and certified conflict free by a strict
system of forgery resistant documents and serial numbers. This
documentation is re-certified each time a rough diamond crosses an
international border. We can tell you from personal experience
that while the Kimberly Process is intended to control the flow of rough
diamonds, that it can be challenging to ship lab graded, polished
diamonds, across borders because the customs departments of major
countries of diamond imports such as the United States, Canada and the
European nations are exceptionally zealous and strict in the enforcement
of the demands of the Kimberly Diamond Act.
At present, the Kimberly Process is law in 69 countries and is backed by
the United Nations. As diamond dealers, we are required to source
the diamonds which we sell only from suppliers who comply with the
provisions of the Kimberly Diamond Act and which have provided us with
written assurance that the diamonds have been mined and processed by
legitimate means which are free from conflict. Because of the
Kimberly Process, more than 99% of all gem quality diamonds are from
sources which are conflict free. But the diamond industry will not
stop its efforts until conflict diamonds no longer exist and the illegal
trafficking of conflict diamonds is completely eradicated.
While we'll be
the first to admit that the Kimberly Diamond Act of 2003 is not perfect,
the reality is that the diamond industry is consciously acting from
within to protect the integrity of the diamond market by attempting to
police the traffic of diamond rough mined from legitimate sources.
The unfortunate reality of the Kimberly Diamond Act is that the laws
created on behalf of its concept are a lot like drug laws to the degree
of their effectiveness, those people who tend to be law abiding citizens
and who would already conduct their business lawfully, morally and
ethically were doing so before the inception of the law and those who
are prone to participating in illegal activities will continue to do so
regardless of what laws and procedures may be in effect. If laws
were effective, marijuana wouldn't be one of the largest cash crops in
America today and half of Hollywood would never have to admit to having
ever had or currently be participating in rehab for cocaine abuse.
The fact is that the vast majority of diamonds mined in the Sierra Leone
are obtained through the efforts of good, hard working people who rely
on the mining industry for their livelihood. People who deserve a
chance to earn a living through honest employment. It may be
argued that the economic resources to be found within the Sierra Leone
are the focus of much of the bloodshed that reportedly occurred in the region
during the civil war,
however it may also be argued that without the efforts of legitimate
mining establishments within the region that the only mining that would
occur would be at the hands of miners held at gunpoint and that without
the intentions of the Kimberly Diamond Act that the movement and
subsequent sale of those diamonds would be uninhibited, free to enter
the market and be sold without a trace.
We acknowledge that tragedies occurred within the Sierra Leone region
due to illegal mining activities spurred by the activities of their
civil war, however we also recognize the importance of promoting
economic development within the region through the efforts of humane
mining operations conducted by legitimate mining operations such as the
DeBeers
Diamond Trading Company (DTC) and other legitimate mining ventures.
To the best of our knowledge, all of the diamonds that we represent are
sourced from diamond rough mined under the supervision of legitimate
mining enterprises. All of the diamonds that we sell are sourced
from legitimate businesses registered and licensed within the diamond
industry and who actively participate and support the guidelines set
forth by the Kimberly Diamond Act of 2003. We don't buy diamonds
"off the street" from people who walk into our store, we don't buy
diamonds cash and we don't buy diamonds without an invoice nor from
companies which are not established within the diamond industry.
